Privacy Policy

Measure Education Inc. (“MeasureED”, “we”, or “us”) provides data management and related services to educational institutions, such as local educational agencies and schools (individually referred to herein as “School” and collectively as “Schools”), with the goal of continuously improving educational outcomes for students.  We treat privacy as an incredibly important issue for all stakeholders whose information we may access on behalf of a School.

This Privacy Policy applies to our services we provide to Schools, and describes how we collect and use School information, including student, teacher, and School staff data, and the steps we take to protect their data.

WHAT INFORMATION WE COLLECT

MeasureED may have access to personally identifiable information from student education records (“Student Data”), which includes:

  • Identifying information, such as student first and last names, addresses, contact information, and date of birth, teacher and School staff first and last names and contact information;
  • Non-public education information (per the Family Educational Rights and Privacy Act (FERPA), such as grades, enrollment data, class lists, student schedules, student identification codes, student financial information, and student disciplinary and attendance records; 
  • Protected classification data, including race/ethnicity of students, language proficiencies, disabilities, gender identification, and age;
  • Professional or employment-related information, including teacher and School staff employment duration, position and titles; and
  • Sensitive information, including when a School administrator corresponds with us by phone or online, we may ask for account name and password, and other information related to accessing School information systems. 

HOW WE COLLECT INFORMATION

  • Access to School Information Systems: In order to provide our data analysis and management services, we are typically granted access to School information systems.  School information systems include, but are not limited to, student information and testing systems, data storage providers and state and federal reporting systems.  We may securely download or otherwise access this data to produce a School’s requested deliverables.  We never interact with students or parents directly to obtain Student Data or other School information.
  • Data Submissions from Schools: We may also receive and retain information provided by a School if the School transmits Student Data or other information to us by e-mail or other means.

HOW WE USE INFORMATION

MeasureED considers Student Data and other sensitive School data, such as account information to access School information systems, to be confidential.  We use School information consistent with the authorization provided by the School, in compliance with applicable laws and regulations, and for the following purposes:

  • Provide Services to Schools: MeasureED will only collect, use, and retain School data, including Student Data, for purposes related to the provision of our services to the School. 
  • No Sale or Rental of School Information: We do not sell or rent School information.

HOW WE SHARE INFORMATION

MeasureED may need to share or disclose information to third parties as follows:

  • Service Providers / Vendors: MeasureED may share School data, including Student data with third parties that provide us with services that are strictly related to the delivery of MeasureED’s services to Schools. These third parties may include other School vendors, cloud service and storage providers, and IT services. Please note this Privacy Policy applies to the MeasureED services, and not other third-party applications or services, which may have their own privacy policies. Schools should read the privacy practices of each third party application or Service before agreeing to engage with them.
  • Government Entities: MeasureED may share School data with various governmental entities and agencies, including to State and Federal Departments of Education, in order to submit compliance reports as requested by the Schools.
  • Law Enforcement and Other Legal Purposes: We may disclose School data to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims, and to protect or defend the rights, interest, health, safety, and security of MeasureED, our affiliates, Schools, students, or the public.  In these circumstances, we shall attempt to notify you and work with you to respond to any such requests, if the law permits.

We do not use, disclose, or sell School data, including Student Data, for cross-context behavioral advertising purposes or to develop profiles of any individuals.

PROTECTION OF INFORMATION

The security and confidentiality of our client Schools’ information is very important to us. We implement commercially reasonable physical, technical, and administrative security methods to protect the information we collect from Schools. MeasureED maintains strict procedures to protect information stored in our servers, workstations and the servers of our service providers.  Access to information is limited to employees who require it to perform their job functions. Other security safeguards include but are not limited to usage of multiple factor authentication and strong passwords, virtual private networks and physical access controls to building and files.  While the security of a School’s information is of the utmost importance to us, we cannot absolutely guarantee the security of any information a School chooses to disclose.

ACCESS TO DATA

MeasureED has established reasonable procedures by which it can support Schools in permitting parent/legal guardian/student review or correction of Student Data. MeasureED will respond in a timely manner to the School’s request. In the event that a parent, legal guardian, student, or other individual contacts MeasureED to review any Student Data, MeasureED will refer the parent or individual to relevant School.

DATA RETENTION

Following termination or deactivation of a School account or services contract, MeasureED may retain client profile information and content for a commercially reasonable time for backup, archival, or audit purposes.

Physical copies of Student Data will be disposed of in a physical destruction process that takes reasonable precaution to ensure the data cannot be recovered or recreated thereafter.  Any and all Student Data associated with the School will be deleted within 18 months, or immediately upon request.  Please send all such requests to privacy@measureeducation.com.

SUCCESSOR ENTITIES, SALE OR MERGER

In the event of the sale of assets or merger of MeasureED, Schools will be provided with notice no later than sixty (60) days after the closing date of sale or merger with an opportunity to opt-out of the transfer of Student Data.

CHANGES TO THIS POLICY

MeasureED may periodically change or update this Privacy Policy from time to time as necessary.  If we change this policy in a material manner, we will endeavor to provide at least 30 days’ notice before the changes take effect to the School if they are a current user of the service.

ACCOUNTABILITY

MeasureED is performing an institutional service or function for Schools, and therefore is a school official with a legitimate educational interest in Student Data under the Family Educational Rights and Privacy Act (“FERPA”).

 MeasureED does not knowingly collect any information online from children under the age of 13.   Please contact us at privacy@measureeducation.com if you believe we have inadvertently collected personal information from a child under 13 without a School’s or parental consent.
